Individual Project 2
These situations with Joe's actions are not legal, because this is a problem with discrimination; also there are laws that protect people from things like this. It's illegal to use discrimination against home buyers, and say no due to their race and gender. This problem that Joe has is a very bad one; this can lead to a lawsuit and civil actions being pressed against Joe and Mary Parker. You just cannot tell a person no because of their background, race, or gender; this isn't what's buying the home. Those people were rejected due to information from word of mouth, and it was used to stop the sale of a home. I mean, nobody cares who buys a home and how much they spend, nor if there gay or not, this is not what puts a roof on people's heads.
It's just doesn't make any sense to treat someone this way when trying to purchase a home. There is a law that protects people from things like this and it called the Fair Housing Act of 1968. This stops unlawful discrimination that happens in all federal administered housing programs that is based on religion, race, color, sex, nationality or any other type of race or gender. This protects people from being unable to rent or own due to discrimination, and prohibits practices involving housing, sales, rentals, advertising, and financing. It's the law to sell homes or whatever you may do and you are not to refuse to sell, rent, or negotiate due to a person's background or gender. So, Joe is in the wrong for denying them the home, and besides the home is $300,000 dollars, that's a lot of money. Nobody in the neighborhood will care and they will not know if they do not tell them. That's the reason why a lot of neighborhoods are the way that they are today, because of discrimination. Therefore, it's illegal to discriminate the sales or rentals of a dwelling to a person who does not have a disabling condition, and whose ownership or tenancy will not cause direct threat to the health and safety of other individuals, all homes have to be accessible to persons with disabilities.
There are many laws that protect minorities from things like this and they are as follows.
The Civil Rights Act of 1964 - contains a language in the Title VI that prohibits housing discrimination in any program receiving federal assistance. All businesses need federal assistance in order to be opened; therefore you cannot discriminate if you are receiving help.
The Department of Urban Housing or HUD protects minorities also when in the purchasing process for a home. If you think there is a case of discrimination HUD will take care of the case and if discrimination was present, they will take legal actions to get the case cleared and you in a home.
Discrimination in all ways is illegal and is taken care of as they are received by the court system and other business that help with discrimination. Most African Americans face discrimination for loans more than Caucasians who ask for them and due to this many African Americans do not get loans because of this type of discrimination. Joe should have asked the couple themselves before proceeding to make a decision on the buy, that's the reason why he will have a problem selling homes from there on, also this sticks to your records everywhere you go, because it is illegal in United States. Mr. and Mrs. Parker cannot be forced, but they can be dealt with by a court system for discrimination and face charges if found guilty of this type of discrimination. In most cases, when the people who ask of the case win, they usually get the home; so forcing isn't in the air right now; it's all about if discrimination is the reason. Forcing someone to do something that they do not want to do with their property is illegal, but selling the home is different and also you cannot base a home sale, advertisement, or anything by race or gender, it's illegal and causes many problems with the Supreme Court of Law.
There have been cases in NJ, where two men were discriminated on for their apartment and could not move in due to discrimination. They took the realtor to court and now live there in the apartment. Forcing people to do things or work when they own is unfair and by law illegal. But, when you are receiving help from the federal government, you cannot discriminate nor push, force, or tear down, because of not being able to occupy or own a house or apartment anywhere, it's just not tolerated. With all the new laws and new ways of handling discrimination, we should leave discrimination to the court system; it's unfair, illegal, and time consuming. That couple was hounded for their natural ways that they have. People cannot change once they are grown, so due to their natural ways, they cannot be forced to change in exchange for material things in life. Everything and everyone deserves a fair trial, and until justice is prevailed, the laws for discrimination will continue to be practiced.
